These Terms of Service (“Terms”) govern your use of the website www.callcube.com and the services provided by CallCube (“we,” “us,” or “our”), including but not limited to Voice AI, VoIP, SMS, IT infrastructure, and related communication services.
By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Services
CallCube provides AI-powered communication solutions, business VoIP, and IT infrastructure services. The specific features, availability, and pricing of services are described on our website and in individual service agreements.
2. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
3. Acceptable Use
You agree not to use our services to:
- Violate any applicable laws or regulations
- Transmit any unlawful, harassing, defamatory, or fraudulent content
- Interfere with or disrupt our services or networks
- Attempt to gain unauthorized access to our systems
- Use our services for unsolicited bulk communications (spam)
- Violate the Telephone Consumer Protection Act (TCPA) or similar regulations
- Use AI services to generate misleading or deceptive content
4. Voice AI and Call Recording
- AI-powered call handling is provided as part of our Voice AI service
- Call recording features are subject to applicable federal and state laws
- You are responsible for ensuring compliance with call recording consent laws in your jurisdiction
- CallCube provides tools for automated consent disclosure but does not provide legal advice on compliance
- AI-generated responses are based on the data you provide and may not always be accurate
5. Payment and Billing
- Fees for services are as described in your service agreement or on our website
- Payments are due according to the billing cycle specified in your plan
- We reserve the right to modify pricing with 30 days advance notice
- Failure to pay may result in suspension or termination of services
- Refunds are handled on a case-by-case basis as described in your service agreement
6. Service Level and Uptime
We strive to maintain high availability of our services. Specific uptime guarantees, if applicable, are described in individual Service Level Agreements (SLAs). Scheduled maintenance will be communicated in advance when possible.
7. Intellectual Property
- All content, software, and materials on our website are owned by or licensed to CallCube
- You may not copy, modify, distribute, or create derivative works without our written permission
- You retain ownership of content you upload to our platform (documents, audio, data)
- You grant us a limited license to process your content for the purpose of providing our services
8. Third-Party Services
Our services integrate with third-party providers including cloud infrastructure, AI models, and communication networks. Your use of these integrated services is also subject to their respective terms and policies. We are not responsible for the availability or performance of third-party services beyond our reasonable control.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLCUBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OUR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless CallCube, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.
11. Termination
- Either party may terminate services with 30 days written notice
- We may suspend or terminate your account immediately for violation of these Terms
- Upon termination, your right to use our services ceases
- Data retention after termination is subject to our Privacy Policy and applicable laws
12. Dispute Resolution
These Terms are governed by the laws of the State of New York, United States. Any disputes arising from these Terms shall be resolved through binding arbitration in New York, NY, in accordance with the rules of the American Arbitration Association, unless both parties agree to resolve the matter in court.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or through our website. Your continued use of our services after changes constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
